Both of these statements are ingenuous and false.

California state law is clear. It requires all licensed contractors to carry worker’s compensation and other protections for employees…and their customers.

  • Is the company licensed? This is probably the most effective way to ensure compliance. Ask a patio contractor for a copy of its California State Contractor (CSC) license and verify it on the state’s website. By law, licensed contractors are required to include their state license number on business cards, bids and contracts. All advertising, from a website advertisement to the side of truck, must also carry the state license number.
  • Ask for a copy of the Certificate of Insurance. If not available, ask for the name and contact information of both the contractor’s insurance carrier and insurance agent. Call both to verify. If a contractor has any employees, he or she must also have worker’s compensation insurance. Most contractors also carry commercial general liability insurance, although it is not required.

The risk to homeowners:

For homeowners, the risk of using uninsured workers on your property is significant. If there is no worker’s compensation policy in place and there is an accident or injury on your property, you may be responsible financially for medical care and rehabilitation expenses. Your homeowner property insurance policy may or may not cover claims of this nature. For this reason, after receiving a copy of the patio contractor’s insurance, you should check with your own insurance carrier to be sure the coverage is adequate.
